Six Ways Your North Carolina Workers’ Comp Lawyer Can Help You

SIX WAYS YOUR NORTH CAROLINA WORKERS' COMP LAWYER CAN HELP YOU

by King Law Firm

Trust is crucial when dealing with injuries, and even doctors we typically rely upon may not act in your best interest by downplaying the severity of our injuries. Thus, in nearly every workers’ comp case, an attorney can be beneficial. The following sections outline six of the most common ways our workers’ compensation lawyers in North Carolina have assisted previous clients.

1: WORKERS’ COMP LAWYERS CAN SIMPLIFY THE FILING PROCESS

Filing for workers’ compensation can be overwhelming due to complex regulations, paperwork, and jargon. Hiring a workers’ compensation attorney can simplify the process and provide clarity. An expert lawyer can guide you through the filing process, explain benefits, and handle the paperwork. There may be more options than you realize, such as compensation for work-related car accidents. With an attorney, you can get a realistic estimate of when you’ll receive benefits and ensure you receive fair compensation without any issues.

2: Expert Workers Comp Negotiation Partner.

Negotiating can be difficult for many, but with the help of an experienced lawyer in North Carolina, you don’t have to do it alone. Having a workers’ comp lawyer on your side is essential when facing insurance companies. They’ll assess the value of your injuries and work tirelessly to get you the compensation you deserve, including medical expenses, lost wages, and related costs. If you’re completely disabled, your lawyer will fight for every dollar owed to you, making the negotiation process stress-free and successful. With a professional by your side, you won’t have to worry about being taken advantage of or arguing with insurance companies.

3: Get the Evidence You Need for Your Workers’ Comp Case

If you’ve been injured at work, gathering evidence may be the last thing on your mind. But with one call to a workers’ comp lawyer in North Carolina, you can leave it to them. Your lawyer will gather essential evidence, including witness statements, photos, employment and medical records, and workplace safety hazards. This evidence can help prove your injuries and qualify you for compensation and medical benefits, even if your employer denies your claim. With a lawyer handling the evidence, you can focus on recovering. Hiring a lawyer to gather evidence is a wise move that can significantly impact the outcome of your case. Don’t wait to call a workers’ comp lawyer if you’ve been injured at work.

4: Get Legal Representation for Your Workers’ Comp Appeal Trial

If negotiations fail, settling a workers’ compensation claim may not be possible. In North Carolina, workers’ comp appeals go to court, and not all lawyers are willing to represent clients in court. However, at King Law Firm, we’ll represent you in court against your employer or their insurance company. Our experienced lawyers will present evidence and argue in your favor for maximum benefits. While self-representation is possible, having a lawyer increases your chances of getting what you deserve. Don’t face your workers’ comp appeal trial alone. Hire a lawyer to fight for your rights and ensure you receive compensation and benefits. We’ll provide legal representation and support at King Law Firm throughout the process.

5: A Workers’ Comp Lawyer Can Help You If Your Employer Has Threatened You.

It’s not unusual for employers to respond severely when injured workers exercise their right to workers’ compensation. If you file for workers’ comp benefits, your employer may threaten to decrease your working hours, demote your position, or terminate your employment. However, these threats are not permissible in Birmingham, AL, and if you have been threatened, you can take legal action. A proficient workers’ benefits attorney knows that such threats are illegal and can take appropriate measures to safeguard you from such employers while ensuring you receive your financial award, despite any severe treatment.

6: When Your Employer Doesn’t Provide Workers’ Comp Insurance, a Law Firm Can Assist You

North Carolina companies are required to have workers’ compensation insurance if they employ three or more employees to protect both the business and workers. If an employee is injured due to work, the employer cannot just fire them and expect to pay nothing. However, some companies try to avoid insurance payments by not obtaining workers’ comp insurance, which is illegal.

If your employer is uninsured, a lawyer can help you understand your legal options, such as filing personal injury claims or filing for permanent disability through Social Security. Hiring the right workers’ comp lawyer is crucial in maximizing your benefits.

King Law Firm is a team of Board-Certified Workers’ Compensation Attorneys who can help you secure your compensation and fight for your rights when insurance companies or your employer deny them. Dangers of 18-Wheeler Blowouts

Dangers of 18-Wheeler Blowouts

The Dangers of 18-Wheeler Blowouts

Driving can present many dangers and hazardous situations. You have to worry about other drivers maneuvering erratically, construction work, animals crossing the road, and inclement weather.

Even though you may not think about it, you need to be concerned about truck tire blowouts. A blowout can occur anywhere at any time, but several factors increase its likelihood.

In an accident involving a commercial truck tire blowing out, drivers who share the road with trucks must understand how and why these accidents occur.

What causes an 18-wheeler truck tire to blow out?

Tire blowouts result from a truck’s tire bursting and suddenly losing air, often increasing the risk of the truck swerving or careening violently out of control as the tire and rubber of the tire are sent flying into traffic. The Federal Motor Carrier Safety Administration (FMCSA) reported that in 2019,” ‘Other Working Vehicle’ and ‘Tires’ were the most common vehicle-related factors for large trucks in fatal crashes.”

Tire blowouts can occur for various reasons, some more preventable than others and some more common. There are several reasons why truck tires blow out, including:

Under Inflated Tire Pressure:

Low tire pressure is the most common cause of tire blowouts. The following factors affect tire inflation: tire damage, wear on valves, and temperature fluctuations. All of these methods can cause a tire to lose air. Truck drivers must regularly check the air pressure in their tires, and there are several options available to them, such as digital tire monitoring systems. With these tools, you can instantly check the air pressure in all the tires, preventing them from becoming underinflated without the driver noticing.

Mechanical problems.

Taking care of and updating all parts of the tire is essential. Besides the tread and rubber of the tire, bolts, kingpins, ball joints, and wheel bearings are also included. The tire will wear down faster when worn, damaged, or lost.

Tires that are mismatched.

A tire blowout can occur when the tires in dual positions on a truck do not have the same type of tread, their tread patterns differ, or their air pressure differs even slightly. If a truck driver suspects their tires are different types (by checking the tread depth on each tire), they should replace them to match exactly. Tires that are not matched cause premature wear and tear, and if tires are inflated with as little as a 5 PSI difference, they will have the same result as mismatched tires.

The incorrect installation or improper equipment.

Equipment that determines how the tires are oriented, or having the wrong tires for the occasion, can cause undue wear, making them weaker and more prone to blowouts. Tires that are not appropriately seated and axles that are not aligned properly fall into this category.

The operation of the truck in a manner that wears out the tires unnecessarily.

Tires can wear out when the driver uses too much torque. It is possible to avoid this situation by not turning the steering wheel so aggressively or not driving so fast, but sometimes this is impossible. They should be rotated frequently to even out the wear on the tires. Going too fast on super single tires is another way truckers wear down their tires. For commercial trucks, super single tires are an increasingly popular option. The tires on these trucks can also wear out if they are driven too fast, so truck drivers are advised to follow the speed limit.

Hazards and impacts on the road.

Most drivers think of this as the most common cause of tire blowouts. It is easy to spot evidence of this damage when the tire is examined later, whether caused by a deep pothole or running over a sharp object.

Regardless of what causes the truck’s tire to blow out, the damage it causes and the drivers around it is just as dangerous.

When a tire blows out, what kind of injuries can occur?

Damage can be devastating when a large, thick piece of hot tire plummets into traffic at high speeds. As well as wrecking a car, it can also cause severe injuries to the drivers and passengers. Car accidents caused by truck tire blowouts can cause the following injuries:

  • Traumatic brain injuries (TBI)
  • Spinal cord injuries and paralysis (quadriplegia/tetraplegia and paraplegia)
  • Back Injuries.
  • Burns.
  • Internal injuries.
  • Fractures and broken bones.
  • Disfiguring facial injuries and scars.
  • Limb loss and amputation.

It is more likely that motorcyclists, bicyclists, and pedestrians will suffer catastrophic injuries on the road due to their less protected status.

Hiring a personal injury lawyer is vital for several reasons.

First, a personal injury lawyer has the knowledge and expertise to navigate the legal system and advocate on your behalf. They are familiar with the laws and regulations that apply to your case and can help you understand your rights and options. This is especially important if you need to become more familiar with the legal process or are facing an insurance company trying to lowball your settlement offer.

Second, a personal injury lawyer can help you get your deserved compensation. The damages from a personal injury can be significant, including medical bills, lost wages, and pain and suffering. A personal injury lawyer will know how to value your damages and negotiate with the other party to get you the maximum compensation possible.

Finally, hiring a personal injury lawyer can take the burden off of you. Pursuing a personal injury claim can be time-consuming and emotionally draining. By hiring a lawyer, you can focus on your recovery while your lawyer handles the legal aspects of your case. This can give you peace of mind and allow you to move on with your life.

Fast-Food Slip-And-Fall Accidents Can Happen

North Carolina Personal Injury Lawyers

A person from another state recently claimed that she suffered injuries at a local fast-food establishment due to the carelessness of the staff.  She recently filed a lawsuit against the fast-food establishment, seeking damages for the injuries she received. In the same way, customers in North Carolina who suffer injuries in slip-and-fall accidents or other types of accidents at businesses due to property owners’ carelessness have the right to seek damages in civil court.

In the recent out-of-state case, the woman claimed that she was at the McDonald’s establishment back in April. All of a sudden, she reportedly stepped on a wet floor and fell. The alleged fall caused her to suffer permanent and severe injuries.

According to the woman, the establishment did not offer sufficient warnings about the Hazardous condition of the floor. In addition, the restaurant did not offer a safe outlet for customers to move around. As part of her lawsuit, the woman is seeking damages of over $70,000.

Business owners in North Carolina and elsewhere are expected to keep up their establishments so as to prevent their customers from getting injured on them. Unfortunately, this does not always happen. If customers end up suffering harm in slip-and-fall accidents due to the business owners’ negligence, it is within their rights to file premises liability claims against these business owners. A successfully fought liability suit might lead to a damage award that may help the plaintiff to cover his or her medical bills as well as the loss of income, in the event that he or she could not return to work immediately following the incident.

If you or a family member have had an accident at a fast-food restaurant or any other type of business, you may be able to recover damages for your injuries, medical bills and loss of wages. Contact the King Law Firm Today for a free case evaluation

Workers Compensation Medical Treatment Rules

Workers Compensation Medical Treatment Rules

North Carolina Workers’ Compensation Lawyers

Since the Workers’ Compensation carrier has been paying for your medical treatment, when your doctor has referred you to another doctor or for additional testing such as an MRI, you may think you should just be able to make the appointment and go.

That isn’t always the case. While there is usually a seamless transition to the new doctor or for the test, the evaluation or the test must be approved by the Workers’ Compensation carrier’s adjuster. The adjuster has to tell the new doctor, or testing facility, that the comp carrier will guarantee payment of that visit.

Often times this may take a day or two because your doctor’s office has to get that referral and supporting records to the adjuster and the adjuster has to give authorization to the new provider. The new provider may opt not to make the appointment and put it on the doctor’s schedule until they have received this approval.

The North Carolina Workers’ Compensation statute provides that the Worker’s Compensation carrier may challenge whether the additional evaluation or testing is necessary. Call the King Law Firm today for a free case evaluation.

Preventing Pedestrian Accidents On Halloween

Preventing Pedestrian Accidents On Halloween

North Carolina Personal Injury Lawyers

Every Halloween night, a parade of costumed children and adults flood the streets in pursuit of sugary treats, spooky parties, and a ghoulishly good time. However, Halloween isn’t all fun and games and trick-or-treating. Various safety groups release warnings each year about the increasing number of injuries and fatalities associated with this holiday—and the danger has nothing to do with ghosts going bump in the night. The most dangerous hazard to pedestrians is, as usual, cars and trucks.

At King Law Firm, our Jacksonville pedestrian accident attorneys have created a list of important safety tips to help pedestrians and drivers avoid unfortunate accidents on Halloween night.

Safety Tips for Pedestrians

If you and your children are planning to mosey through neighborhoods or urban areas this Halloween, you may want to review this helpful list before your departure:

Prepare a safe travel route in advance.
If you can, plan a group outing with friends or fellow neighborhood parents. As they say, there is safety in numbers, and a driver has a better chance of seeing a group than a single person.
Keep track of any children who may dart out into the street.
Wear a bright costume that is easy to see in the dark. If you can, attach reflective tape so drivers have a better chance of noticing you.
Carry a flashlight or a glowstick, particularly if you’re in a dark area. This can help you avoid tripping hazards and a car accident.
Stay on well-lit sidewalks and only cross the street at designated areas.

Safety Tips for Drivers

To guarantee a safe Halloween, both pedestrians and drivers need to be absolutely focused on their surroundings. We’ve compiled this list to help drivers avoid unfortunate pedestrian accidents:

Stay alert in residential and urban areas, particularly between 5:00 p.m. and 10 p.m.
Drive very slowly and look out for people wearing dark costumes.
Turn your headlights on even if it isn’t dark. This can help you see pedestrians at greater distances.
Avoid using your cell phone or participating in other dangerous distracted driving behaviors.
Watch out for costumed children thoughtlessly darting into the streets.
Be wary of distracted pedestrians jaywalking or crossing streets, especially if they are using their cell phones.

Injured on Halloween? File a Claim.

The Jacksonville pedestrian accident lawyers at King Law Firm have been representing personal injury claims for over 30 years. Our firm has successfully recovered over $50 million in damages on behalf of our clients. If you’re injured by a driver this Halloween, contact our attorneys to explore your legal options.
