In 1929 the North Carolina General Assembly created the North Carolina Industrial Commission (NCIC) to enforce and administer the North Carolina Workers’ Compensation Act. The NCIC expanded In 1949 to administer the Tort Claims Act. Workers’ Compensation, also known as Workman’s Comp claims, is currently processed by the North Carolina Industrial Commission (NCIC) for the State of North Carolina. Both evidentiary and administrative hearings are before judges known as Special Deputy Commissioners, the Executive Secretary, Deputy Commissioners, and Commissioners. The North Carolina Workers’ Compensation Act administers sending cases to mediated settlement conferences, handling appeals, and processing motions.
A Look Inside The NCIC
A chairperson and six commissioners govern the North Carolina Industrial Commission. Contested Deputy Commissioners at the county level initially hear Workers’ compensation claims at evidentiary hearings. Medical motions and other motions, such as Form 24’s, are heard by Special Deputy Commissioners in Raleigh hear medical motions and other motions like Form24’s. When a Deputy Commissioner’s ruling gets appealed by one or both parties, the Full Commission (six commissioners and the chair) typically hears the cases. The decisions made by the Full North Carolina Industrial Commission may be appealed by both employers and employees, to the North Carolina Court of Appeals, followed by the North Carolina Supreme Court, under certain circumstances.
